Use of the Service

You agree to indemnify us and hold us harmless for damages arising out of your use of, or failure to use, and/or access to the service and information provided through this service, violation of these Terms, and/or violation of any third-party rights.

ONPATH CREDIT UNION AND ITS AFFILIATES, EMPLOYEES AND AGENTS ARE NOT RESPONSIBLE FOR AND HAVE NO LIABILITY FOR ACTIONS TAKEN BY YOU OR A THIRD PARTY OR NOT TAKEN BY YOU OR A THIRD PARTY WITH RESPECT TO USE OF OR INABILITY OR FAILURE TO USE THE SERVICE OR ANY INFORMATION AVAILABLE ON OR THROUGH THE SERVICE. WITHOUT LIMITING THE FOREGOING, IN NO EVENT SHALL CONSUMERS OR ANY PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICE (OR ANY PART THEREOF) BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT DAMAGES OR OTHER DAMAGES RELATED TO YOUR OR OTHERS’ USE OF THE SERVICE, INFORMATION PROVIDED THROUGH THIS SERVICE, INCLUDING WITHOUT LIMITATION DAMAGE CAUSED BY VIRUSES OR ANY INACCURACIES OR INCOMPLETENESS OF THE INFORMATION PROVIDED OR MADE AVAILABLE THROUGH THE SERVICE, OR ANY THIRD-PARTY WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING THE FOREGOING, IN NO EVENT SHALL OUR LIABILITY TO YOU RELATING TO THE SERVICE, INCLUDING WITHOUT LIMITATION INFORMATION PROVIDED OR MADE AVAILABLE THROUGH THE SERVICE OR ANY THIRD-PARTY WEBSITE, EXCEED ONE HUNDRED DOLLAR ($100.00).
